Erie County Sheriff's Deputy arraigned on charge of promoting prostitution of his wife

Wallace Waliczek, an Erie County Sheriff's Deputy, is accused of promoting the prostitution of his wife.

LANCASTER, N.Y. — Erie County Sheriff's Deputy Wallace Waliczek appeared in Lancaster Town Court Tuesday morning where he was arraigned on one charge of promoting the prostitution of his wife.

"How exactly he put her out there, in lack of a better phrase, that's going to be evidence that I have to use against him in his case so I'm not going to get into details," said Erie County DA John Flynn.

Police say they responded to an online ad in August for sex and arrested Melissa Waliczek, Wallace Waliczek's wife, outside a movie theater on Transit Road in Depew.

"She drove there I'm not going to comment on whether she was by herself or not," Flynn said. 

Wallace Waliczek was released on his own recognizance and given a non-offensive order of protection to prevent him from discussing the case with his wife and not act menacing toward her. 

Erie County Sheriff's Office spokesperson Scott Zylka says their human trafficking unit started investigating Wallace Waliczek after Lancaster investigators found additional evidence which pointed to his potential involvement.

Wallace Waliczek was immediately suspended without pay from his job as an Erie County Sheriff's deputy on October 8, after his arrest.

Zylka told 2 On Your Side Wallace Waliczek had been assigned to the Jail Management System, which includes a number of units beyond the Erie County Holding Center.

Melissa Waliczek appeared in Human Trafficking Court in Buffalo in October, where her case has been referred. Flynn says it still hasn't been determined whether Melissa Waliczek is a victim or not.

"I want to do further investigation into what her husband may or may not have been allegedly doing to her," Flynn said. 

If it is determined that Melissa Waliczek was a victim, that would open the door for charges to possibly being dropped against her. 

Deputy Waliczek remains suspended without pay from the Erie County Sheriff's Office.
