Western New York hospitals sue feds for rate cuts

BUFFALO, N.Y. — Four Western New York hospitals are among 622 hospitals nationwide suing the federal government for ongoing Medicare reimbursement cuts through a rate reduction that was intended to be temporary.

The lawsuit was filed Nov. 19 in U.S. District Court for the District of Colombia, and targets Alex Azar II, who leads the U.S. Department of Health and Human Services.

The suit challenges Azar’s decision to continue a 0.7 percent reduction in hospital reimbursement into federal fiscal years 2018 and 2019, despite a Congressional directive to recoup no more than $11 billion in overpayments by use of such reductions and to complete that recoupment by FFY 2017.
