Recommendation made to decide whether or not to pursue the death penalty is Tops mass shooting case

The attorney for the victim's families said that the Capital punishment committee has made the recommendation on whether or not to pursue the death penalty.

BUFFALO, N.Y. — Prosecutors said that a capital punishment review committee has made a recommendation to Deputy US Attorney Lisa Monaco regarding the death penalty in the mass shooting case that happened at the Tops on Jefferson in Buffalo.

Monaco will review it and eventually advise US Attorney General Merrick Garland on whether Peyton Gendron's case should be tried as a death penalty case. 

The case will return to court on January 12.
