SARDINIA, NY - The Erie County Sheriff's Office says a male driver of a milk truck is in stable condition after being airlifted to ECMC Saturday afternoon from the scene of an accident at the intersection of Rt. 16 and Rt. 39 in Sardinia.

The milk tanker, carrying 7,000 gallons of milk, was driving northbound on Route 16 when a vehicle driving westbound on Route 39 failed to yield at a stop sign.

According to ESCO the milk truck swerved into the southbound lane to avoid hitting the sedan head-on, but the two vehicles still collided. The milk truck then rolled over and struck a telephone pole.

About 100 homes were still without power at 11:30 p.m. after the accident, according to the Sardinia Fire Department.

Several vehicles following the milk truck immediately pulled over to assist the driver of the milk truck, which caught on fire after it rolled over.

One good Samaritan told 2 On Your Side that he used a fire extinguisher from his truck to start putting the fire out and other began using spilled milk to also douse the flames.

The driver of the milk truck, who hasn't been identified publicly yet, was conscious while bystanders assisted him. Mercy Flight was called in to transport him to ECMC where he's listed in stable condition.

The woman driving the sedan was not intoxicated according to ESCO, and charges will be pending according to a deputy on the scene.
