NIAGARA COUNTY, N.Y. — An investigation on a fatal crash from December of 2022 has resulted in the 43-year-old driver accepting the plea to the crime of Criminally Negligent Homicide.
On Tuesday in Niagara County Court, William C. Giambelluca entered the plea for the death of 72-year-old Judith Schultz.
At the time of the incident Schultz had been waiting to make a left-hand turn from the median turning lane on Transit Road in Lockport when Giambelluca rammed into her vehicle.
“Ms. Schultz was simply going about her ordinary business when her life was tragically ended by this defendant’s total disregard for those around him,” said District Attorney Seaman.
An investigation by Vehicular Crimes Bureau Chief Christine Savoia found that Giambelluca had been speeding down the median while not making any effort to slow down or avoid Schultz's vehicle.
Giambelluca is set to return to court on March 26 for sentencing. His sentence could result in 1 1/2 to 3 years in prison, and will have to be served consecutively due to an undischarged parole sentence from 2018.
