Bill passed in response to Lockport Cave incident

A bill has been passed aimed at keeping local attractions safe following a boat capsizing during a tourist tour in the City of Lockport last fall.

LOCKPORT, N.Y. — The State Assembly and Assemblyman Mike Norris announced today that they have passed a bill in regards to the Lockport Caves accident that happened last fall and took the life of a Niagara Falls man. 

In the bill it will require an annual inspection for any vessel that is operated privately or publicly owned in an underground non-navigable waterway. 

“Proper oversight of these rides has been a top priority of mine during this legislative session to protect both the patrons who wish to partake in these unique attractions and business operators going forward,” said Norris. “I am pleased there was bipartisan agreement of the final bill’s language submitted by the governor and that the bill will be sent to the governor for her signature. I am confident this legislation addresses an apparent loophole in current law and provides the clear authority and responsibility for the Office of Parks, Recreation and Historic Preservation to inspect these tourist attractions annually.”

Earlier last month lawmakers had initially introduced the 'Cave Safe' bill which was supported by Governor Kathy Hochul. 

At the time when the bill was still in the approval process Hochul said that "The safety of all visitors to sites like the Lockport cave is paramount. It cannot be compromised. And that is why I put in a bill to close the loophole, that once it's done, we'll ensure proper accountability and safety. And I'm very proud that the Senate has just taken this up again. There's still time, in my opinion, between now and the end of session, which is not until June. So, I'm hopeful that they will expedite this understand the urgency that I bring to this and we can hopefully get it over the finish line in time for me to sign it later this year".

Today the State Assembly passed a bill (A.10399) that will require the annual inspection of any vessel operated on privately or publicly owned underground non-navigable waterways. I worked together with Sen. Rob Ortt and our colleagues across the aisle to pass the legislation in order to ensure attractions such as the one in the Lockport Cave are properly inspected.
