Jury Finds Lackawanna Man Guilty in Wife's Death

It took an Erie County Court jury less than an hour to find a Lackawanna man guilty in the death of his wife.

BUFFALO, NY - It took an Erie County Court jury less than an hour to find a Lackawanna man guilty in the death of his wife.

The six men and six women found 28-year-old Daniel Whiting guilty of 2nd degree murder following the week long trial.

The final witness Tuesday was the medical examiner, who detailed the stab wounds Daniel and Ashley Whiting had.

About a year ago, police were called to a home on Madison Avenue in Lackawanna. They found Whiting and his wife 21-year-old, Ashley, with stab wounds. Ashley Whiting would later die at a hospital.

After a week-long investigation, police charged Daniel Whiting with murder in his wife's death. Police say he stabbed himself to make it appear as if he was a victim.

But during trial, defense attorneys have argued that it was a home invasion, and a third person broke into the house, attacking the couple.

"He gave almost a four-hour statement to the police, explaining that someone came in the house stabbed his wife and him, while he was fighting with the person, we contend that the people have not proven their case beyond a reasonable doubt," said defense attorney Andrew LoTempio.

When Ashley Whiting was killed, police say that the couple's two young children, a boy and a girl, were inside the home at the time. But, both children were not hurt. The kids are now in the care of a relative.

Whiting will face sentencing in August.
