Buffalo Police officer not facing charges in Molly's pub incident

A Buffalo Police officer suspended for his involvement in the Molly's Pub incident that led to the death of a national guardsman will not be facing any charges.

BUFFALO, NY-- A Buffalo Police officer suspended for his involvement in the Molly's Pub incident in May 2014, which led to the death of an Air National guardsman will not face any federal charges.

U.S. Attorney William Hochul says Buffalo Police Officer Adam O'Shei did not violate federal laws on the night William Sager, Jr. was critically injured. Sager died several months after the incident. Sager was pushed down a flight of stairs by Jeffrey Basil. Basil, this week, pleaded guilty to manslaughter in Sager's death.

Hochul also says, in a letter to O'Shei's attorney, that O'Shei is not a target of their investigation.

When the incident happened at Molly's, two off-duty Buffalo Police officers were there -- O'Shei and Robert Eloff.

Eloff has been charged with two federal civil rights violations for his roll in the Molly's Pub incident in May 2014 and another alleged incident that happened in February 2014.

Basil will be sentenced in July. He faces between 15 and 21 years in a state prison.
