Alleged intoxicated driver indicted in connection to crash that killed an 8-year-old boy

According to police, the driver was allegedly intoxicated when he rammed into the back of the victim's SUV.

HAMBURG, N.Y. — An Erie County man has been indicted for causing a car crash that killed an 8-year-old in Hamburg.

Markus Genovese, 53, of Angola was arraigned Thursday in court on one count of second-degree manslaughter, four counts of vehicular manslaughter in first and second degrees, and one count of leaving the scene of an incident resulting in death.

He plead not guilty to all charges. 

The Erie County District Attorney’s Office say Genovese was driving his pickup truck on Lake Shore Road in Hamburg on June 8 when he allegedly rear-ended the victim’s SUV.  Investigators say Genovese was allegedly under the influence of drugs or alcohol and was driving without a valid license. Genovese allegedly ran from the scene and was found in the nearby woods, said the DA’s office.

There were two children in the backseat of the victim’s SUV. The DA’s Office said that an 8-year-old child died and the 4-year-old was taken to Oishei Children’s Hospital where he was treated and released.

Genovese remains held without bail and awaits an August 15 pre-trial conference. Genovese could face a maximum sentence of 15 years in prison if convicted of the highest charge.
