BUFFALO, N.Y. — Buffalo Police say they have made an arrest on an attempted sexual assault on Virginia Street.
Police were called just before 11am on May 1 to a report of a woman being attacked. According to Buffalo Police, the woman said she had been followed by an unknown male onto a porch. The man allegedly attempted to forcibly take the woman's pants down, knocking her over and causing injuries.
Police say witnesses were able to help the woman, while the suspect fled the scene. Officers later found the man, matching the witnesses description, several blocks away on South Elmwood Avenue and Tracy Street.
Juan Escalante Gudiel, 31, of no permanent address, is charged with one count Attempted Sexual Misconduct, one count of Assault in the Third Degree, one count of Forcible Touching, and one count of Harassment in the First Degree, a class B misdemeanor.
US Border Patrol placed an immigration detainer on Esclante Gudiel to hole him for immigration related proceedings. A judge has ordered a forensic evaluation as well.
"If he's not competent, then we won't be able to proceed with the charges against him and he'll be he'll remain in treatment in in a in civil confinement, but we won't know that until until the forensic exam is completed," acting Erie County District Attorney Michael Keane said Friday.
