CLARENCE, N.Y. — A Williamsville man was sentenced to state prison Wednesday for stealing from two different retailers in the Town of Clarence four separate times, resulting in the loss of over $12,000 in products.
Acting Erie County District Attorney Michael J. Keane said that David J. Miller, 60, will serve three and half to seven years in prison for stealing clothing, high-end eyeglasses frames, and other merchandise from two stores between June 9 and June 20 in 2023.
Officials say none of the stolen merchandise was recovered from the first three thefts, but on the fourth incident, all stolen property was returned.
"Retail theft is financially devastating for stores, especially our small business owners," Keane said Thursday in a statement.
He continued, "I want the residents of Erie County to know that retail crime will not be tolerated and I am committed to holding offenders, particularly repeat offenders, accountable. I am pleased to announce that this defendant received a significant sentence for this series of crimes. We will continue to prosecute serial shoplifters to the fullest extent of the law and seek restitution for the victims."
Miller pleaded guilty to one count of grand larceny in the third degree, two counts of grand larceny in the fourth degree, and one count of petit larceny.
As part of his plea, Miller was required to sign Confessions of Judgment for each retailer as well as a trespass notice. He has also paid back full damages to the two victims.
