West Seneca Police officer resigns after pleading guilty to official misconduct

BUFFALO, N.Y. — A West Seneca Police officer has pleaded guilty to official misconduct.

Derek Vasquez, 35, admitted to having a sexual encounter with a victim of a domestic incident while on-duty in January 2019.

Investigators say Vasquez had previous contact with the victim after filing a Domestic Incident Report on her behalf prior to the encounter. Vasquez was not dispatched to the location where the encounter took place. 

Vasquez resigned from the West Seneca Police Department on Thursday. 

His case will be transferred to the Buffalo Veterans Court. If Vasquez completes the program, the official misconduct charge will be reduced to Disorderly Conduct, a violation.

A one-year, no-contact order of protection was issued on behalf of the victim.
