2 men arraigned in Club Marcella shooting

The victim was taken by ambulance to ECMC where he is still being cared for with serious injuries.

BUFFALO, N.Y. — The fourth shooting to happen at Club Marcella this year, allegedly involves Ramon L. Lopez, 29 and Yeramell Benitez, 20 of Buffalo.

Erie County District Attorney John Flynn announced that Lopez was arraigned Tuesday morning before Buffalo City Court Judge Andrew LoTempio. He is charged with one count of Gang Assault in the First Degree. Benitez was arraigned on Monday, also before Judge LoTempio on one count of Gang Assault in the First Degree.

According to Buffalo Police, the two men are believed to be involved in a group assault inside a bathroom at Club Marcella on Sunday around 2:30 a.m.

The male victim, who suffered a gunshot during the attack, was taken by ambulance to ECMC where he is still being cared for with serious injuries.

If Lopez and Benitez are convicted of the charge, they will face a maximum sentence of 25 years in prison.

The case is being prosecuted by Chief Eugene T. Partridge, III of the Major Crimes Bureau and is still under investigation by the Buffalo Police Department.

District Attorney Flynn commended the Buffalo Police Department for their work in this ongoing investigation.

Both defendants are scheduled to return to court on Friday, December 8 at 9:30 a.m. for a felony hearing.
