BPD: 2 suspects arrested after allegedly hitting a police car, injuring 3 officers

Two suspects were arrested Sunday after allegedly hitting a police car with a stolen vehicle in Buffalo.

BUFFALO, N.Y. — The Buffalo Police Department said two suspects were arrested on Sunday in connection with an alleged stolen vehicle that hit a police car. 

That crash caused injuries to three officers.

According to the news release, around 10:30 p.m. Sunday patrol officers saw a stolen Jeep Commander driving northbound on Niagara Street at Forest Avenue.

Police alerted the Erie County Sheriff’s Air 1 of the vehicle, which monitored its movements through the city. Air 1 notified officers that the vehicle stopped in a parking lot on the 200 block of Breckenridge Street. The officers approached the vehicle, pulled off, and started traveling on the north side of the lot, then drove on the sidewalk along Auchinvole Avenue before failing to yield to oncoming traffic at Grant Street, hitting a police vehicle and injuring two police officers.

After the crash, police said the alleged driver of the stolen vehicle refused to comply with orders from police to get out of the vehicle and claimed to be armed. Police used their Taser and the driver was then removed from the vehicle. 

The alleged suspects in the vehicle, Nilo Pena Delgado, 37, and Diana Mix, 31, were taken to ECMC where they were treated and released police said. 

The two officers in the police vehicle that was hit were transported to ECMC. Police said one officer was treated and released while the second remained hospitalized with more serious injuries. 

The third officer was injured while removing the driver from the vehicle. That officer was taken to ECMC where he was treated and released.

According to the news release, Nilo Pena Delgado is facing charges for one count NYS PL 165.50, Criminal Possession of Stolen Property in the Third Degree, a class D felony; one count NYS PL 120.20, Reckless Endangerment in the Second Degree, a class A misdemeanor; one count NYS PL 205.30, Resisting Arrest, a class A misdemeanor; one count NYS PL 195.05, Obstruction of Governmental Administration in the Second Degree, a class A misdemeanor; one count NYS PL 165.05-1, Unauthorized Use of a Vehicle, a class A misdemeanor; one count NYS PL 165.40, Criminal Possession of Stolen Property in the Fifth Degree, a class A misdemeanor; one count VTL 1212, Reckless Driving; one count VTL 1143, Failure to Yield Right of Way When Entering Roadway; one count VTL 1225-A, Driving a Motor Vehicle On a Sidewalk; one count VTL 0511-3A, Aggravated Unlicensed Operation of a Motor Vehicle; and one count VTL 1172-0A, Failure to Stop at a Stop Sign.

Diana Mix is facing charges of one count NYS PL 165.50, Criminal Possession of Stolen Property in the Third Degree, a class D felony, and one count NYS PL 165.05-1, Unauthorized Use of a Vehicle, a class A misdemeanor.
