BUFFALO, N.Y. — The person of interest in the shooting deaths of two men on Zenner Street in Buffalo should soon learn what charges he will formally face in the case.
Dale Cummings is being held on a criminal possession of a weapon charge. His attorney told 2 On Your Side that the case has gone to a grand jury.
Cummings is scheduled to appear in court on May 13. He's being held without bail.
"It appeared we were prepared to conduct a felony hearing to determine whether he should be held in custody any longer," Nick Texido said. "We learned that the prosecution has already presented the matter to a grand jury, and apparently a grand jury has voted. I don't know what the charges are at this time."
Buffalo Police said Babul Meah and Abu Yousef were shot and killed April 27 by someone who they say was squatting in a home on Zenner Street.
"The felony hearing in the People v. Dale O. Cummings that was scheduled to occur this morning has been adjourned pursuant to New York State Criminal Procedure Law Article 180.80 due to action of the Grand Jury on the felony complaint pending in Buffalo City Court," the Erie County District Attorney's Office said Friday in a statement.
Buffalo Mayor Byron Brown shed light on what happened when he appeared for his weekly "Talk of the Town" radio show on WUFO radio on Sunday. He said the two victims were members of the Bangladeshi community.
Buffalo Police Commissioner Joseph Gramaglia said they both had addresses in Buffalo.
Brown said the shooting had nothing to do with race, adding that it was not a hate crime.
"Obviously they're members of our community, and so the community is trying to raise money today for the widows of these gentlemen,” Brown said Sunday. “One of the men had two children, and a young baby on the way, and another one of the men had seven children. So, these were two innocent men there for work, and sadly, incredibly, in the wrong place at the wrong time."
