BUFFALO, N.Y. — An update on the federal trial against the Tops mass shooter came on Wednesday.
2 On Your Side learned that Payton Gendron wrote a letter, asking to waive his appearance at future court appearances. We obtained this the letter, signed by the shooter, on Nov. 11.
That was just four days before what would have been his most recent court appearance.
The letter says in part, "I have authorized my attorneys to communicate with the court on my behalf ... about whether I want to be present at this or future court appearances."
The judge previously said Gendron may have to appear in court down the road, if there is witness testimony.
