Batavia Walmart evacuated following a gun threat

The person was not holding a shotgun. Rather, it was a pellet gun that the person was returning to the store because it didn't work properly.

BATAVIA, N.Y. — What appeared to be a gun threat led to customers and employees being evacuated Wednesday at a Batavia Walmart.

Law enforcement officers told 2 On Your Side that they got a call about a person loading a shotgun in the Walmart parking lot and going into the store.

Turns out, it was not a shotgun. Instead, it was a pellet gun that the person was returning to the store because it didn't work properly.

No criminal charges will be filed, according to the Genesee County Sheriff's Office.

"At no fault whatsoever," Genesee County Chief Deputy of Road Patrol Brian Frieday said. "I'm glad the person called in, because it's the see something, say something. I'm glad they called in. I know it creates a little bit of an inconvenience for patrons of the store, the store itself, anybody around, even traffic around.

"But that's a great outcome. It's s little bit of an inconvenience compared to everything we're seeing around the country now."
