Grand Island man arraigned in court on charges connected to illegal cannabis sales

Thomas Muscoreil, 23, is charged with criminal possession of cannabis 2nd degree, which is a Class E Felony.

GRAND ISLAND, N.Y. — A Grand Island man was arraigned in court Wednesday for allegedly selling illegal cannabis products

Thomas Muscoreil, 23, is charged with criminal possession of cannabis 2nd degree, which is a Class E Felony, for selling cannabis concentrate, cannabis edibles, and cannabis flower.

Muscoreil operates the Island Smoke Shop, and Island Smoke Shop 2 on Grand Island Boulevard, which were raided by the Erie County Sheriff's Office on February 27.  Deputies seized cannabis and cash from the illegal dispensary on Grand Island Boulevard.

Despite the seizure of cannabis by the sheriff's office, the business remains open.

The investigation into the activities at the two dispensaries started after ESCO received a tip from Grand Island Central School District Superintendent Dr. Brian Graham.

During a recent community forum, the school received anonymous information that the business was selling cannabis to students.

“I will continue work with the New York State Office of Cannabis Management and local law enforcement to investigate illegal marijuana dispensaries operating in Erie County. If you are found in possession of more than a lawful amount of cannabis or are selling unregulated products to a person under the age of 21, you will be prosecuted. Anyone with information on illegal cannabis sales is encouraged contact my office, their local police department or the Office of Cannabis Management,” said Erie County District Attorney John Flynn in a release.

Muscoreil is scheduled to return on to court on April 24, 2024 for a felony hearing. He was released on his own recognizance.
