BUFFALO, N.Y. — A Buffalo man was sentenced to 10 years in prison for being an accomplice in a shooting outside a bar in 2021.
Luis Martinez, 52, was sentenced in Erie County Court Wednesday after a jury found him guilty of Attempted Murder in the Second Degree, Criminal Possession of a Weapon in the Second Degree, and Assault in the Second Degree in May. In addition to the prison time, Luis Martinez will also serve five-years post release supervision.
Investigators say Luis Martinez was an accomplice in a shooting outside a bar on Clinton Street in Buffalo on July 3, 2021. They say Luis Martinez and his twin brother Jose Martinez were kicked out of the bar following a fight. The brothers are said to have left area together in a pickup truck driven by Luis Martinez.
A short time later, investigators say Luis Martinez drove back to the bar with his brother. Jose Martinez then fired multiple shots at several people who were standing outside. One person was shot and taken to ECMC. Both brothers fled the scene in the truck driving by Luis Martinez.
A short time later, at approximately 12:45 a.m., Luis Martinez drove back to the tavern with his brother. Upon their return, Jose Martinez fired multiple shots at several patrons who were standing outside of the building. Several people ran after the initial shots were fired. When the weapon jammed, Jose Martinez continued to attempt to fire the gun at one victim as he stood outside. After clearing the gun, Jose Martinez shot a second victim, who was laying on the ground. After the shooting, Jose Martinez again fled in a pickup truck driven by Luis Martinez. The injured victim was taken by ambulance to ECMC where she was treated for three gunshot wounds to her lower body.
Jose Martinez, 52, of Buffalo had pleaded guilty to one count of Attempted Murder in the Second Degree for in September 2022. He was sentenced to 10 years in prison followed by 5 years of post-release supervision.
