West Seneca man found guilty on all counts for order of protection violations

A West Seneca man has been found guilty by a jury on all counts for the multiple violations he committed while having an order of protection placed against him.

WEST SENECA, N.Y. — A West Seneca man has been found guilty by a jury on all counts for the multiple violations he committed while having an order of protection placed against him. 

Jason M. Mitchell, 43, was found guilty on the following charges:

  • Two counts of Burglary in the First Degree (Class “B” violent felonies)
  • Two counts of Criminal Contempt in the First Degree (Class “E” felonies)
  • Three counts of Endangering the Welfare of a Child (Class “A” misdemeanors)
  • Three counts of Criminal Contempt in the Second Degree (Class “A” misdemeanors)

The trial took four days and jurors came to a decision on Friday, April 26 after eight hours of deliberation.  

On September 16, 2020, Investigators say Mitchell knowingly and intentionally disobeyed the order of protection that had been issued by an Erie County Court judge. He had reached out to the victim through a social media website at the time of the first incident. 

Following the first attempt, Mitchell again disobeyed the order of protection two more times on September 25 and 27 of 2020. He had went to the victim's home these times causing her fear that she would get physically injured by him. 

These incidents continued on November 4, and November 26 when Mitchell unlawfully entered the victim's home with the intent to commit a crime. He had threatened to use a sledgehammer to break through the door and caused the victim to break her wrist while attempting to hold the door shut. Two children were home during this time. 

Mitchell faces 29-years in prison when he is sentenced before the State Supreme Court on June 12. He remains being held without bail.
