Buffalo pharmacy agrees to pay U.S. over violation of Controlled Substances Act

A Buffalo pharmacy is being fined over $140,000 after failing to maintain accurate records relating to purchases and sales of certain controlled substances.

BUFFALO, N.Y. — A Buffalo pharmacy has agreed to pay over $140,000 to the United States after failing to maintain records relating to purchases and sales of certain controlled substances.

According to U.S. Attorney Trini E. Ross, Dexter Prescription Center, also known as Dexter Pharmacy, violated the record-keeping provisions of the Controlled Substances Act (CSA) and overcharged federal health care programs.

An investigation by the U.S. Drug Enforcement Administration revealed that between Jan. 1, 2018, and Feb. 1, 2021, failed to maintain accurate records relating to its purchases and sales for certain controlled substances.

Dexter Pharmacy additionally billed federal healthcare programs for medications, including controlled substances, that were never dispensed by the practice.

“My office is committed to stopping the potential abuse of prescription drugs in our community,” Ross said in a statement. 

“The requirement that pharmacies maintain accurate books and records is critical in preventing the diversion of prescription drugs, and we will continue to work with our law enforcement partners to ensure that pharmacies take their obligations to safeguard prescription drugs seriously.”
