Fatal crash in South Buffalo leads to sentencing

The vehicle crashed into trees at a high rate of speed while the driver was allegedly under the influence of alcohol.

BUFFALO, N.Y. — A 39-year-old man was sentenced to five years of probation after crashing his vehicle into some trees, contributing to another man's death.

Erie County District Attorney John Flynn's office issued a press release on Monday, December 18, stating that County Court Judge Kenneth Case had sentenced Paul McCaslin, 39, of Buffalo to five years of probation after prosecutors discussed the sentence with family members of the man who died.

44-year-old Christopher J. Kleinbach of Buffalo died from injuries related to the crash which occurred on Saturday, March 18th.

Prosecutors say McCaslin was driving at a high rate of speed while under the influence of alcohol when he crashed into several trees on McKinley Parkway in the City of Buffalo. Prosecutors say McCaslin and Kleinbach were relatives.

McCaslin pleaded guilty to one count of Vehicular Manslaughter in the Second Degree on September 5.  

McCaslin was ordered to pay a fine of $2,000 and surcharges.  Judge Case revoked McCaslin's driver's license for 12 months.  Eventually, McCaslin can apply for his license to be reinstated. If it is reissued, an ignition interlock device will be installed in his vehicle for five years.
