Assault, rape charges against Niagara Falls man will be dismissed

Niagara County District Attorney Caroline Wojtaszek said the female victim died over the weekend, leaving no testimony. The incident happened in February of 2019.

LOCKPORT, N.Y. — A case involving a man who was accused assault and rape in February of 2019 will be dismissed.

Niagara County District Attorney Caroline Wojtaszek said Wednesday the case against Eduardo E. Rodriguez could not proceed without testimony from the victim. Wojtaszek says the woman died over the weekend.

Niagara County officials did not say how the victim died, but it doesn't appear to be connected to the case.

Police arrested Rodriguez last year and charged him with first-degree assault and first-degree rape.

According to Niagara Falls Police last year, Rodriguez knew the victim. They say that he invited her to his home, where he allegedly raped and assaulted her in his 10th Street home.

Police also said at the time that she was stabbed, held hostage, and left a blood trail from the house to Niagara Falls Memorial Medical Center before being taken to Erie County Medical Center, where she was placed in a medically induced coma.
