Public Espresso goes after food truck in trademark infringement lawsuit

A popular downtown Buffalo coffee shop filed a lawsuit this week versus a food truck and its owner over trademark infringement.

BUFFALO, N.Y. — A popular downtown Buffalo coffee shop filed a lawsuit this week versus a food truck and its owner over trademark infringement.

Public Espresso, based in the Hotel @ The Lafayette on Washington Street, in a lawsuit filed July 21 in Erie County Supreme Court, said Public Coffee Hub’s branding is confusing to customers, particularly when it is doing business close to its locations.

Public Espresso attorneys, Benjamin Burge and Shawn Byrns of Rupp Baase Pfalzgraf Cunningham LLC, said in the complaint that Public Espresso representatives were alerted by customers in January of the food truck with a similar name. They said it has been seen repeatedly as a vendor near the Buffalo Niagara Medical Campus just blocks from its primary establishment, as well as near Public Espresso’s satellite location at Dash’s Market in Amherst.  You can read the full story on Buffalo Business First's website
