RiverWorks partner alleges unauthorized ownership changes in lawsuit

Developer Douglas Swift has sued Earl Ketry and other partners at Buffalo RiverWorks LLC, claiming breach of contract and unjust enrichment.

BUFFALO, N.Y. — Developer Douglas Swift has sued Earl Ketry and other partners at Buffalo RiverWorks LLC, claiming breach of contract and unjust enrichment.

The lawsuit, filed May 17 with the New York State Supreme Court in Erie County, alleged unauthorized changes in ownership interests and financial irregularities at the waterfront restaurant and event venue founded in 2013 by Swift and Ketry.

RiverWorks, at 359 Ganson St., has expanded in recent years with new banquet facilities and entertainment options, including a Ferris Wheel two years ago.

Swift said in the complaint that Ketry had added members to the company and diluted Swift's interests, despite restrictions in the operations agreement regarding the sale, transfer or other disposition of each members’ interests in the company.

Business First could not reach Ketry, Swift or their attorneys.
