Court battle puts Babcia's Pierogi expansion on hold

EAST AURORA, N.Y. — Babcia’s Pierogi’s planned expansion into the Village of East Aurora is up in the air after a conflict with its landlord.

The owners of the pierogi company filed a complaint Aug. 8 against 33 Elm Street LLC in Erie County Supreme Court, accusing the landlord of failing to address code violations at the property that are preventing inspectors from issuing a certificate of occupancy.

Linda and George Lund, owners of Babcia’s, say in the complaint that the move has resulted in losses exceeding $1 million. The landlord, however, told Business Firstthat the tenant is at fault, leading to an eviction notice in June.

The Lunds are seeking to recoup the cost of equipment and professional services tied to the move, as well as lost business.
