EAST AURORA, N.Y. — Babcia’s Pierogi has resolved a court battle against its landlord and is now planning a late January opening in the Village of East Aurora.
The company in August filed a complaint against 33 Elm St. LLC in State Supreme Court in Erie County, alleging the building owner failed to address code violations at the property, which prevented inspectors from issuing a certificate of occupancy. The lawsuit sought to recoup the cost of equipment and professional services tied to a move, as well as lost business.
Separately, the building owner began an eviction proceeding for nonpayment of rent, which was stayed by the courts in October. Jon Minear at the Law Office of Ralph C. Lorigo, who represented Babcia’s owners Linda and George Lund in the case, confirmed the two sides resolved the issues just before Thanksgiving.
